RENTAL AGREEMENT
Please read carefully before placing your final order & understand that your payment AND/OR booking with Abilene Yard Greetings (hereby referred to as AYG) signifies that you (purchaser) agree to be bound by the following terms & conditions:
IMPORTANT DELIVERY INFORMATION:
§ Set Up/Pick Up: Rental price includes delivery, set up, and take down of your yard greeting. All greetings will be set up between 6pm the night before and 11 am on the day of. We cannot guarantee specific times unless otherwise discussed. All signs are picked up anytime the DAY AFTER your event or last rental day (equating to approximately 24 hrs per rental day). If you have questions regarding how to schedule or have special needs related to times, please text 325-864-3847 before booking. (*Note: Personalized graduation signs will follow an alternate set up/pick up schedule that can be found on the graduation tab.)
§ Inclement Weather: We will not be able to deliver your yard greeting if there is heavy rain, lightning, snow, ice or other hazardous weather conditions that may prevent safe set up and/or take down. If we are unable to reschedule the greeting with you, a full refund will be issued.
§ Yard Quality & Hazardous Conditions: Though we will try all reasonable methods possible to install, depending on the surface and soil quality, we cannot guarantee sign installation is possible on every yard. PLEASE WATER YOUR YARD for at least 3 days prior to sign delivery to ensure the ground is prepped for installation. (To ensure we are able to stake your yard, it is recommended that you check to see if it would pass the "pencil test" - you should be able to easily push an unsharpened full length pencil fully into the ground until it reaches the eraser. ) Additionally, we will not attempt delivery if hazardous conditions such as loose dogs or wild animals are present or possible. Please ensure all pets are restrained and notify AYG if there are potential risks to be aware of during set up. If we are unsuccessful in installation due to yard quality or hazardous conditions, you will be issued a full refund less a $25 travel & processing fee for the central Abilene area. This fee will be higher for those out of the central Abilene area. (NO REFUNDS WILL BE ISSUED FOR PERSONALIZED GRADUATION GREETINGS IF WE ARE UNABLE TO SET UP ; INSTEAD, WE WILL LEAVE YOUR SIGN AT YOUR DOOR (less stakes & flair) TO USE AS YOU PLEASE.) In addition, as greetings are sometimes set up after dark, we also ask that you please leave outdoor lights on until your greeting is set up. As an additional safety measure, this agreement also signifies your agreement to ensure that an adult in the home is aware that we will be accessing the property for set up/pick up. If at any time, there is a potential safety concern, AYG reserves the right to refuse service for hazardous conditions.
PAYMENT: Payment is due at time of booking and must be cleared prior to delivery. Please be advised that your greeting is not officially scheduled until payment is made and; Therefore, delayed payment may result in loss of your reserved date.
CANCELLATIONS: A minimum of a 48 hr. cancellation notice before the date of the event is required to be eligible for a 50% refund. If you choose to cancel within the agreed upon timeframe, you will be refunded 50% of the total payment (less processing fees) or you may reschedule for the full value paid, based on availability. Cancellations made within 48 hours of the scheduled set up are not eligible for refund.
ALL SALES OF PERSONALIZED PHOTO AND GRADUATION GREETINGS ARE FINAL AND NOT ELIGIBLE FOR REFUND AFTER YOU HAVE APPROVED THE PROOF FOR PRINTING.
PROPERTY: All signs are the property of Abilene Yard Greetings and any damage, destruction or tampering with the yard signs is prohibited. Please do not move or remove any signs without prior consent from Abilene Yard Greetings. Please also ensure that sprinkler systems are turned off and notify any yard service companies that the greeting is present to avoid damage. Should a sign be damaged, lost, or stolen, whether or not intentional, you will be held liable for the replacement of each graphic/letter and stakes at full replacement value and agree to allow Abilene Yard Greetings to charge your card on file for any of these replacement fees. Additionally, you are agreeing to notify any recipients whom you may be sending your yard greeting to of these terms and conditions to which you are bound and agree to be held responsible to all terms and conditions as the purchaser. For any pick-up or DIY set ups, you also agree to return all signs, stakes, and parts as bound by the terms in your additional DIY sign agreement. (*For graduation and personalized photo greetings, your payment acknowledges your agreement to return all stakes, posts, and added "flair" such as stars, diplomas, balloons, etc., at the agreed upon time. )
RIGHTS: Abilene Yard Greetings is independently owned & reserves the right to refuse service to any patron as well as to politely decline orders that are political, controversial, lewd, disrespectful, or that do not fit the celebratory nature of our business at our discretion.
HOLD HARMLESS: By booking, you agree to defend, indemnify, and hold harmless the owners and employees of Abilene Yard Greetings from all liability and claims for any and all losses, penalties, settlement costs, damage or injury to person or property, and/or other charges arising from or assumed to have arised from your Abilene Yard Greetings rental or purchase. This includes any damage to homeowner property regardless of whether the recipient was aware or personally scheduled the booking.
